Welcome to Sovelie!

The terms “we”, “us” and “our” refer to MA Assistance, operating under the brand name Sovelie.

Sovelie operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).

Sovelie is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you use our Services.

Please read these Terms carefully. They contain important information about your legal rights and obligations.

By visiting, interacting with or using our Services, including purchasing products through our website, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms limits or excludes any mandatory statutory consumer rights that apply to you under applicable law.

We reserve the right to discontinue products or limit quantities where reasonably necessary.

Nothing in this section affects your statutory rights where a product does not conform to the sales contract or does not match the information provided to you before purchase.


SECTION 3 – ORDERS

When you place an order through our website, you make an offer to purchase the products in your order.

After placing an order, you will receive an order confirmation at the email address you provided.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, payment problems, incorrect pricing, stock unavailability or obvious errors.

If we cancel an order after payment has been received, any amount due to you will be refunded to your original payment method.

Please review your order carefully before submitting it.

If you notice an error after placing your order, please contact us as soon as possible at info@sovelie.com. We cannot guarantee that an order can be modified or cancelled once it has entered processing or fulfilment.

Returns, withdrawals and refunds are handled in accordance with our Return & Refund Policy and applicable consumer law.

Products purchased through our consumer store are intended primarily for personal or household use.


SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change from time to time.

The price applicable to your purchase is the price displayed and agreed at the time your order is placed.

Prices displayed to consumers include applicable VAT where required by law. Any additional delivery charges or other applicable charges will be clearly communicated before you complete your purchase.

You agree to provide current, complete and accurate purchase, payment and account information.

You represent that you are authorized to use the payment method provided for your purchase.

Promotional offers may be subject to separate conditions. Where specific promotional conditions conflict with these Terms, the specific promotional conditions will apply to that promotion, subject always to mandatory consumer law.


SECTION 5 – SHIPPING AND DELIVERY

Available shipping methods, estimated delivery times and applicable shipping costs will be communicated during the ordering process or elsewhere on our website before purchase.

Delivery times are estimates unless a specific delivery date or period has been expressly agreed.

We will make reasonable efforts to deliver your order within the indicated timeframe.

Where mandatory consumer law provides you with rights in the event of delayed delivery, those rights remain unaffected.

Where Sovelie arranges the shipment of products to you, the risk of loss or damage remains with us until you, or a third party designated by you other than the carrier, physically receives the goods.

If you independently appoint a carrier that was not offered by us, different rules regarding the transfer of risk may apply in accordance with applicable law.


SECTION 6 – INTELLECTUAL PROPERTY

The Services and their content, including trademarks, trade names, logos, text, graphics, images, videos, audio, designs and other materials, are owned by or licensed to Sovelie, MA Assistance or their respective licensors and are protected by applicable intellectual property laws.

You may use the Services for your personal and non-commercial use.

Unless expressly permitted by law or by us in writing, you may not reproduce, distribute, modify, republish, display, sell, license or commercially exploit our content.

The name Sovelie, associated logos, product names, designs and slogans may constitute trademarks or other protected intellectual property and may not be used without authorization.

Shopify's names, trademarks and intellectual property remain the property of Shopify and its respective licensors.

All third-party trademarks displayed through the Services remain the property of their respective owners.


SECTION 7 – OPTIONAL TOOLS

We may provide access to tools, applications or services offered by third parties.

We do not necessarily monitor or control these third-party tools.

Your use of third-party tools may be subject to the terms and privacy policies of the relevant third-party provider.

To the extent permitted by applicable law, we are not responsible for third-party tools or services that are outside our reasonable control.

We may introduce additional features, tools or resources in the future. Unless otherwise stated, those features will form part of the Services and be subject to these Terms.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Sovelie is powered by Shopify, which enables us to provide the Services to you.

However, any sale or purchase you make through our store is made directly between you and Sovelie, operated by MA Assistance.

Shopify is not the seller of the products offered by Sovelie.

Your contractual relationship regarding products purchased from our store is with MA Assistance, operating under the Sovelie brand, except where explicitly stated otherwise.


SECTION 10 – PRIVACY POLICY

Personal information collected through the Services is processed in accordance with our Privacy Policy and applicable data protection laws.

Because our store is powered by Shopify, certain personal information may also be processed by Shopify in connection with providing its services and infrastructure.

Certain other service providers may process personal information on our behalf where necessary to operate our store, process payments, fulfil orders, provide customer service, prevent fraud, perform analytics or provide other business services.

SECTION 11 – FEEDBACK AND REVIEWS

If you voluntarily submit feedback, reviews, photographs, videos, suggestions or other content to us (“Feedback”), you grant us, to the extent permitted by applicable law, a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display and distribute that Feedback for purposes related to operating and promoting Sovelie.

You represent that you have the necessary rights to submit such Feedback.

You must not submit content that infringes third-party rights, contains unlawful material or intentionally provides false or misleading information.

Where you have received compensation, free products or another incentive in connection with a review or other Feedback, this must be disclosed where required by applicable law.

We may moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, abusive, offensive, misleading or infringes third-party rights.


SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability.

We reserve the right to correct genuine errors and update information.

If an error affects an order you have already placed, we will handle the situation in accordance with applicable contract and consumer law.

Nothing in this section allows us to unilaterally remove rights that you have already acquired under mandatory law.

However, we cannot guarantee that the website or other digital Services will always be uninterrupted, error-free or available.

Nothing in these Terms excludes or limits warranties, guarantees or other consumer rights that cannot legally be excluded or limited.

Products purchased through our store remain subject to all applicable statutory conformity and consumer-protection requirements.


SECTION 17 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MA Assistance and Sovelie will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the agreement was concluded.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms limits your mandatory statutory consumer rights or any liability that cannot legally be excluded under applicable Dutch or EU law.


SECTION 18 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising directly from your unlawful use of the Services, your infringement of third-party rights or your material breach of these Terms.

This section does not impose liability on consumers beyond what is permitted under applicable law.


SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.


SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies and other terms expressly incorporated into them, govern your use of the Services and your contractual relationship with us.

Nothing in this section limits rights arising under mandatory consumer law.


SECTION 21 – ASSIGNMENT

You may not transfer your contractual rights or obligations where such transfer would materially affect our rights or obligations without our prior consent, except where applicable law provides otherwise.

We may transfer our rights or obligations where legally permitted, provided that doing so does not reduce your mandatory consumer rights.


SECTION 22 – GOVERNING LAW AND DISPUTES

These Terms and agreements between you and MA Assistance, operating under the Sovelie brand, are governed by the laws of the Netherlands.

If you are a consumer residing in another EU or EEA country, this choice of law does not deprive you of mandatory consumer protections available to you under the laws of your country of residence where those protections apply.

Any dispute will be submitted to a competent court in accordance with applicable law.

Nothing in these Terms restricts any mandatory right you may have to bring proceedings before a court that has jurisdiction under applicable consumer law.

Headings used in these Terms are included for convenience only and do not affect the interpretation of these Terms.


SECTION 24 – CHANGES TO THESE TERMS

You can review the current version of these Terms of Service on this page.

We may update these Terms where reasonably necessary, for example due to changes in our Services, business operations or applicable law.

Where required by law, we will provide appropriate notice of material changes.

Changes will not retroactively remove rights that you have already acquired under an existing purchase agreement.
